We've been sharing the road with Pot smokers for some time.  But now that Marijuana has been legalized in Washington State, I guarantee there will be more.  Last night in my Vancouver Neighborhood, one of those pot heads hit and killed a pedestrian.  Ordinarily the dead man would be at fault, because he walked out into traffic and not at a crosswalk.  But the police say that because the driver of the car was high on marijuana, he’s legally at fault.  They think this is the first Pot related fatality since legalization.  Here’s the way I figure it.  People smoke the drug, but now that it’s legal more will join them.  And it’s going to be harder to prosecute marijuana intoxication.  With a breathalyzer you can measure blood alcohol closely.  But Pot stays in your blood for days and when cases come to court, you’re going to see defense attorneys argue that the smoker wasn’t tokin’ the day he drove.  So people heading out to party will quickly figure out that inhaling means less chance of prosecution than imbibing.  And all that stuff about pot heads being safer drivers…try telling that to the man killed by Scotty Rowles last night.
