(PENDLETON) The Oregon Department of Corrections says an inmate was shot by a guard during a fight this morning at the state prison in Pendleton.
D.O.C. says a guard fired the shot from a yard tower after two inmates who were assaulting a third inmate failed failed to stop.
According to the Corrections Department, the shot was fired to prevent “imminent serious bodily injury” to the inmate who was being assaulted.
The inmate who was attacked was treated for his injuries. The third inmate is in disciplinary segregation.
Withers was serving time for robbery, identity theft, and negligent homicide.
The prison went into lockdown after the incident and visiting was cancelled. Several agencies are conducting an investigation.
