Oregon Sues The Makers Of Five Hour Energy

Salem, Oregon – Five Hour Energy is fighting back after being slapped with a lawsuit by the state of Oregon. The state claims the company makes “deceptive and misleading claims” about what it can do. Attorney General Ellen Rosenblum said in a news release “this lawsuit is about requiring truth in advertising. Plainly and simply, in Oregon, you cannot promote a product as effective, if you don’t have sufficient evidence to back up your advertising claims.”

The suit says one of the misleading claims is that  Five Hour Energy will not cause users to experience a crash.

Five Hour Energy tells the Oregonian ” when companies are being bullied by someone in a position of power, these companies roll over, pay the ransom, and move on. We’re not doing that. Oregon’s Attorney General, Ellen Rosenblum, is grasping at straws, and we will fight to defend ourselves against civil intimidation.”

      Claims must be supported by empirical evidence – when no such thing was required there were many tonics and gadgets of quackery
