OR Attorney General to Implement Gay Marriage

PORTLAND — Oregon’s attorney general has told a federal court why she believes the state’s voter-approved ban on same-sex marriages violates the federal rights of homosexual couples. And Attorney General Ellen Rosenblum adds that Oregon is “prepared to implement” gay marriages if a federal judge strikes down that ban.

Rosenblum announced last month that she would not defend the state’s same-sex marriage ban in court.

Two lawsuits alleging Oregon’s 2004 ban violates the U.S. Constitution have been consolidated. U.S. District Judge Michael McShane has scheduled April 23 oral arguments in the case.

The Oregonian reports that in a 35-page brief filed Tuesday, Rosenblum says there is no rational justification for maintaining the gay marriage ban. She also says that federal constitutional protections for same-sex couples have become clear since Oregon voters approved the ban.

Excerpts from the brief in response to the federal marriage equality court case below.

“Because the same-sex marriage ban does not further the state’s interest in protecting and promoting families and actually damages that interest, there is no rational justification for maintaining the ban.”

“Not only does the same-sex marriage ban fail to further the state’s interest in promoting stable families, it actually harms children.”

“The state defendants in this case have carefully analyzed the legal issues presented and find no satisfactory justification on which to defend the state’s ban on same-sex marriages, which blocks those unions from not only the many federal benefits, but also the full societal recognition and support of marriage”

“Other state attorneys general and governors have reached similar conclusions about the defensibility of state laws, and responded by simply declining to appear in defense or withdrawing and joining forces with those challenging the laws. The Oregon state defendants believe it is more appropriate to remain as parties to this litigation to ensure that this Court has the benefit of the careful legal analysis that the state defendants have undertaken”

“Protecting traditional marriage is not a rational justification for the ban on same-sex marriage.”

“Not only does the same-sex marriage ban fail to further the state’s interest in promoting stable families, it actually harms children.”

“We now live in a state that recognizes and values same-sex couples and their families. “

    I am a registered voter. We have vote several times about same sex marriage and every time it has been banned. So, please tell me why our vote doesn’t matter? A court official not willing to uphold the law? How can you over turn a ban that was what the voters voted for? Crazy. Support what the people voted for.
