Washington High Court Tosses Heroin Convictions

The Washington state supreme court today overturned 2 drug convictions from Cowlitz county.  Both involved privacy rights.

The court ruled, 5 to 4, that even suspected heroin dealers have a reasonable expectation that police would not read their text messages without a warrant.  That’s what Longview police did to Daniel Lee. Officers also posed as Lee to set up meetings where they arrested two men for heroin possession.

The court ruled the men had the same privacy expectations in those phone texts as they would have in a sealed letter or phone call.  Their convictions were overturned.
