Marijuana Supporters to Battle County Ordinance

Written by Steve Herman on December 16, 2013

SEATTLE (AP) – A Pierce County ordinance that would block licensed marijuana operations may be challenged court.

The News Tribune reports  that supporters of legalized marijuana plan to battle the ordinance. Pierce County Prosecuting Attorney Mark Lindquist says the county plans to rely on the supremacy of federal law if it is sued.

A number of cities and counties around the state have adopted moratoriums seeking to prevent or delay the operation of marijuana businesses. Washington’s Liquor Control Board, which is implementing the legal pot law, has asked the state attorney general for an opinion on whether such measures are legal.

The Pierce County ordinance would block recreational marijuana businesses from unincorporated areas, even if those businesses get a state license to operate.

Washington voters approved marijuana legalization last year.
